Changes to Immigration I-9 Form Completion Requirements Coming Soon
As all employers know, under Federal Immigration law employers are required to verify that new employees have proper identification and can demonstrate their right to work in the United States using the I-9 Form – Employment Eligibility Verification form. The I-9 form must be completed within three days of the employee’s employment. As part of the I-9 form process, employers must inspect the employee’s supporting documents. Because of the COVID-19 pandemic, the government excused employers from conducting the I-9 document inspections in person, which the law required. However, the government just announced that beginning on July 31, 2023, employers must resume in-person physical inspection of I-9 supporting documents.
In addition, employers must also physically examine the I-9 documents of employees who were hired since March of 2020 and who did not submit their I-9 documents for in-person examination previously. This look back requirement has a deadline of August 30, 2023 for employers to complete the in-person review of documents for such employees.
