The OFCCP Compliance Portal Is Open For AAP Certification
The Office of Federal Contract Compliance Programs (OFCCP) has opened its Contractor Portal on March 31, 2023, for existing covered federal contractors to certify compliance with Affirmative Action Program (AAP) requirements for 2023. In our September 5, 2018 WWR article we discussed the new emphasis being placed on affirmative action compliance. Supply and service contractors and subcontractors that hold a contract of $50,000 or more and employ 50 or more employees must develop and maintain AAPs pursuant to Executive Order 11246 and Section 503 of the Rehabilitation Act of 1973. If a contractor has at least 50 employees and a contract of $150,000 or more, then it must also develop an AAP pursuant to the Vietnam Era Veterans’ Readjustment Assistance Act of 1974. Covered federal contractors and subcontractors must use the Contractor Portal to certify, on an annual basis, whether they have developed and maintained an AAP for each establishment and/or functional/business unit. In 2023, existing covered contractors must certify their compliance through the Contractor Portal between March 31 – June 29, 2023.
Existing contractors that have not certified by June 29, 2023, will be more likely to appear on OFCCP’s audit scheduling list than those that have certified their compliance with AAP requirements. New contractors have 120 days to develop their AAP(s) and must register and certify compliance through the Contractor Portal within 90 days of developing their AAP(s).
The OFCCP has posted a pre-recorded webinar to the Contractor Portal landing page on March 29, 2023 that demonstrates how contractors can enter their establishment and/or functional/business unit’s AAP start date and certify compliance through the Contractor Portal.
