H-1B 2023 Registration Period Extended to March 20, 2023
By Jan Pederson
Due to the glitches in the USCIS registration system on March 16 and March 17, which prevented many employers from submitting registrations, the H-1B 2023 registration period has been extended to March 20, 2023 at 5 pm Eastern Standard Time. Please contact Corey Goettsch at legalassistant@wcslaw.com if you need legal assistance to register in the 2023 H-1B lottery.
Great News! Presidential Commission Recommends H-1B Worker Grace Period Between Jobs be Extended from 60 days to 180 days!
In January 2017, USCIS implemented a sixty day grace period between the time of the termination of an H-1B job and the time a new employer files a transfer H-1B petition to a new job, provided:
- The H-1B worker does not engage in unauthorized employment during the grace period.
- The H-1 petition approval/I-94 does not expire during the grace period.
- The grace period has not been previously used during the current H-1B petition/status validity period.
Given the massive recent loss of H-1B jobs in the tech and other sectors, the USCIS is expected to expand the grace period to 180 days soon. This is not yet the USCIS policy. We will keep you updated!
