US Grants Automatic Work Permits to Certain Afghans and Ukrainians
On November 21, 2022, USCIS announced that Ukrainians admitted under the Uniting for Ukraine Parole Program and certain Afghan paroles are now granted employment authorization incident to the parole status, without the need to request employment authorization.
Employers may accept an unexpired I-94 form to demonstrate employment authorization to employers for I-9 purposes for 90 days from date of hire. Ukrainians and eligible Afghans are exempt from paying the I-765 USCIS filing fee. Note that the Form I-765 must still be filed and should be filed online at USCIS.GOV . Attorneys warmly greeted this policy change as it will free up critically needed resources for adjudication of other benefit applications.
