Construction Law
Representation of Fortune 500 contractors and industry leaders in various construction related matters. Representation of all participants in the construction process – owners, developers, contractors, subcontractors, suppliers and design professionals, residential and commercial, in contract drafting and negotiation, contract performance counseling, contract termination, claims preparation and prosecution, claims defense, litigation/ADR and prosecution and defense of mechanics lien actions throughout the mid-Atlantic region. Representation in defense and prosecution of claims for malpractice against or on behalf of architects and engineers. Representation of insureds in construction defect claims, CGL claims and subrogation claims.
Surety Law
Representation of surety clients in pre-default negotiations, investigations and formulation of workout arrangements. Negotiation and drafting of takeover and tender agreements and completion contracts. Representation of surety clients in analyzing and resolving payment bond claims in state and federal courts. Representation of surety clients in state and federal courts defending against performance bond claims. Representation of surety clients before regulatory bodies. Representation of surety clients pursuing contract balances, claims and subrogation against project owners. Representation of surety clients pursuing principals and indemnitors for accountings, access to books and records, indemnification, exoneration and collateral including involuntary bankruptcy proceedings, temporary restraining orders and injunctions.
Government Contracts
Representation of government contractors preparing and asserting claims against the government and defending against claims brought by the government in federal, state and local matters. Preparing and prosecuting bid protests and participation on behalf of clients as interested parties in bid protests brought by others. Counseling of government contractors on federal, state and local government laws, rules and regulations and advising clients on rights and remedies available under various government procurement vehicles. Representation of clients on claims avoidance, contract compliance and performance as well as ADR with various government agencies.
MBE/WBE/Small Business
Representation of minority, women owned and small businesses in socio-economic program certification, compliance and protests in federal, state and local jurisdictions. Advise clients and draft documentation for teaming and joint venture arrangements. Counseling regarding SBA size issues and program qualification including size protests before the SBA. On behalf of clients, successfully challenged the constitutionality of the WSSC’s MBE program.
